Tip Number One

NEVER hang up on a collector.....

When you hang up that action only feeds the fire of their determination to get ahold of you. If it was a wrong number they will assume you would take the time to tell them so. Hanging up means the person is there and you are hiding them. For a unethical collector you may then become a target, they may start calling your relatives and neighbors to get you on the phone. If you have no interest in paying anything- tell the person immediately not to call this for the person they asked for. IF you they call again after that take their name and companies address down because that would be a violation of federal law.

But once they get you on the phone, they refuse to take "no" as the answer or take a person at his word when he says, "I do not have the means to pay it." Which is how he got in that predictiment to begin with.
They assume that if they bug, hassle, and intimidate you enough, that you will come up with the means to pay them some how.

What most people with debts do not know, is that collector, and agency will receive a commission from what the debter pays on the debt. The origional creditor will receive only a few pennies on each dollar collected, but he has already recovered in tax breaks a more substantual percentage of the origional debt from having filed a profit and loss form with the income taxes on his business.
Therefore any and all debts that go to any kind of collector is almost pure profit made on someone elses misfortune, and in some cases that profit margin is as much as 95%.
Debt collecting is one of the most dishonest businesses that is legally allowed to operate.

I am aware of the cease and desist laws and I also know that telling them by phone means nothing. You have to prove in a court of law that you asked them to cease and desist, which verbal testimony of your telling them on the phone is not admissible.

However, what IS admissible is a letter to cease and desist, sent certified mail, with a return receipt, but collectors have ways around that too. Starting with using phoney names on the phone to identify themselves. The agency is of coarse in on this so when you send a check with attention to "phoney name" it is processed and the collector gets his commission.
But a cease and desist letter can be made void in court by the agency simply claimng that they have no such employee by the fake name, and that they don't know who signed for the letter, because certainly nobody in their agency did.

What motivates the collector and his agency is the commission they believe they will receive if they can get debters to pay their "honest debt" at the full price.

If you really want to help us, and teach us how to get the debt collectors off our backs, then tell us how we can convince the collector that we indeed totally lack any means of paying off the debt in question, and that a court judgement against the debter will not recover money that the debter honestly does not have and can not get.
When the collector is convinced there is no way of recovery on a given debt, he will abandon attempts and try to resell the debt to someone else.

These are the kind of things that people need to know about. Not answer the phone, try to barter your way out, allow yourself to be intimidated into agreeing to pay something you already know you can't pay, because if you could you would have, and you wouldn't be dealing with a collector now.
